It has taken months but you have finally selected the materials, colour and decided on the height for your new fence. Now there is just one thing left to do, tell the neighbours.
Each state and territory in Australia has a variation of the Dividing Fences Act. The act relates to the construction and repair of fences that divide adjoining land and aims to help you seek a contribution from your neighbour.
By following this easy action plan you can avoid conflict over the fence.
- Discuss the type of fence, the cost, and how it will be constructed with your neighbour. Supply at least two quotes out of courtesy.
- Once you have reached an agreement, get it in writing by issuing a fencing notice or a notice to repair. This agreement should include: the common boundary to be fenced, kind of fence proposed and a cost proposal (estimate of cost, contribution amounts and construction methods).
- If your neighbour accepts your proposal they will be liable to pay half the cost of the fence.
